Obergefell v Hodges

Celebrating this historic Supreme Court decision today.
James Obergefell and John Arthur James filed a lawsuit challenging the Ohio’s refusal to recognize same-sex marriages. On June 26, 2015, the Court declared their state’s refusal violated due process and the Equal Protection Clause of the Fourteenth Amendment. The right to have one’s marriage recognized by the state is a fundamental liberty interest protected by due process, and the state cannot infringe this right without substantial justification. Ohio cannot assert a substantial, or even rational, justification for its refusal to recognize same-sex marriages.
